The warranty given by the Seller is strictly limited to the sole replacement or repair, at the unquestionable judgment of the Seller, of the components of the Goods presenting original material or manufacturing defects and the Buyer, for the effect, waives any resolution or action Price reduction. This warranty covers manufacturing defects that compromise the functionality of the product to the extent of making it unusable. Aesthetic or minor defects are not covered. By using the Sidea product, the owner agrees to be bound by the terms and conditions of the limited warranty that follow.

 

LIMITED WARRANTY

Every Sidea product has a limited warranty of 1 year, unless it falls under the following definitions:

• Rack Station, Calisthenic Rack, High Performance, Functional Rack, Public Island and Outrace. For the structural parts 2 years for the movable parts 1 year. (PB Rail, pulleys, cables, etc.)
• Painting and surface coatings: 1 year (except for mechanical damage on surfaces).
• Wear parts, fabric, wearables and flooring tiles: 6 months (eg: straps, handles, rubber, elastic parts, etc.).

The movable parts bolted to the frame are not included in the “structural parts” warranty but remain under

the category of “movable parts” for the purposes of warranty times.

Warranty periods start from the date of the purchase invoice issued by Sidea srl to the Reseller.. The parts repaired or replaced through a warranty process will remain guaranteed only for the remainder of the original warranty period based on the date of the purchase invoice.

To make a warranty claim, the Reseller must inform the Sidea srl Technical Assistance Service by e-mail at [email protected] or [email protected], or via WhatsApp at +39 0547 313298 (to be used for sending photos and videos). The Reseller must provide the proof of purchase, indicating the invoice number, together with a detailed description of the defect and extensive photographic and/or video documentation, so that Sidea srl can analyse the problem and determine whether it is due to a manufacturing fault covered by this warranty.

For any Sidea product covered by warranty, Sidea srl will provide, at its sole discretion, one of the following

remedies: (1) repair; (2) substitution; (3) refund of the purchase price.

The warranty does not include transport costs nor other additional costs including customs fees, labour, assembly, disassembly, on site service, technician travel, or call-out costs.

The limited warranty applies to Sidea products only if:

• they have been subjected to correct maintenance;
• complaints are made within the warranty period.

The limited warranty does NOT apply to:

• Sidea products that are resold, installed or used outside the country of the Reseller or different from the final destination declared to Sidea srl at the time of sale;
• Sidea products that have been subject to accidents, misuse, negligence, modifications and installations not approved by personnel authorized by Sidea srl;
• Sidea products that show rust on the parts that are scratched and / or dented and / or worn out by use and / or “peeled off”;
• steel pipes that show rust on the internal surfaces. This phenomenon is considered normal and therefore not covered by the warranty.
• normal wear of components such as pedals, wheels, rubber handles, plastic end caps and, more generally, all rubber or fabric parts, as well as wear of consoles/keypads and wear of paint, opacification or corrosion caused by perspiration (this applies to all equipment and in particular to “cardio” equipment);
• minor defects that do not compromise functionality, such as slight noises, vibrations or squeaks occurring during normal use;
• accidental damage arising from the use of the products (for example, punctures of balls): this warranty is not an insurance and covers only manufacturing defects that make the product unusable.

This warranty is granted exclusively to the original Reseller to whom Sidea srl issued the purchase invoice and is not transferable.

EXCLUSIVE WARRANTY

 These limits replace any other warranties of any kind, either express or implied, including (but not limited to)

guarantees relating to the sale of these products. Under no circumstances will direct or indirect damages from this guarantee be considered covered, including any possible loss of profit or savings resulting from the use or impossibility of use of the products. No one is authorized to modify and/or extend the terms of this limited warranty.

Sidea srl WILL NOT HAVE ANY OBLIGATION OR LIABILITY, BOTH OF CONTRACTUAL NATURE (INCLUDING WARRANTY), EXTRACONTRACTUAL (INCLUDING ACTIVE LEGAL, PASSIVE OR RECEIVED AND OBJECTIVE LIABILITY) OR ANY OTHER TYPE OF DAMAGE TO EQUIPMENT, PROPERTY DAMAGE, LOSS OF USE, REVENUES OR PROFITS, CAPITAL COST, COST OF SUBSTITUTE EQUIPMENT, ADDITIONAL COSTS SUPPORTED BY THE BUYER (THROUGH CORRECTIONS OR OTHERWISE) OR ANY OTHER ACCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, ARISING FROM THE FAILURE DELIVERY OF THE PRODUCT BETWEEN ITS USE, IMPROPER USE OR IMPOSSIBILITY TO USE IT.

This exclusion also applies in the event that the aforementioned warranty does not fulfill its essential purposes and regardless of whether such damages are claimed for breach of warranty, breach of contract, negligent conduct or objective non-contractual liability or on the basis of any other hypothesis of responsibility. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

GOVERNING LAW, JURISDICTION AND LANGUAGE This warranty is governed by Italian law. Any dispute arising out of or in connection with this warranty shall be subject to the exclusive jurisdiction of the Court of Forlì (Italy). This warranty has been drafted in English for Sidea srl’s Resellers in the EU and worldwide.
